Almanak Terms of Use

1. What Almanak is

Almanak shows wallpapers made by the studio and picks a variant for the time of day and the season. On iPhone and iPad it saves pictures to Photos and gives Shortcuts a picture to set. On the Mac it can set your desktop picture, and on Android it can set your Home Screen and Lock Screen and save pictures to your gallery. Almanak is free, with no in-app purchases and no subscription.

2. License to the app

Almanak is licensed to you under Apple's Standard End User License Agreement ("Apple EULA"). These terms add to it. If the two conflict on the same point, the Apple EULA controls for the license to the app itself, and these terms control for everything else. We grant you a personal, non-exclusive, non-transferable, revocable license to use Almanak on Apple devices you own or control, as the Apple Media Services Terms allow. On Android, Almanak is licensed to you through Google Play under these terms and the Google Play Terms of Service, and you may use it on Android devices you own or control. You may not copy, modify, reverse engineer, resell or distribute the app, except where the law lets you regardless of this term.

3. The wallpapers

Every wallpaper in Almanak was made by the studio, and we keep all rights to it. You may use the wallpapers for personal use on your own devices: as your Lock Screen, Home Screen or desktop, and saved to your own photo library. Please do not resell, redistribute, publish or share the files as your own, use them in products or advertising, or use them to train AI models, without our written permission. Some designs were made with the help of AI image tools and then selected and finished by the studio.

4. No account

Almanak has no accounts. Nothing you choose in the app is sent to us. Our Privacy Policy explains what the app downloads and stores.

5. Availability and changes

Almanak downloads its catalog and pictures from our website. We may add, change or remove packs and designs, and the service may sometimes be unavailable. Pictures you have already viewed keep working offline. We may update or stop offering the app.

6. Your device and your wallpaper

Changing the wallpaper on iPhone and iPad is done by Apple's Shortcuts app, which you set up and control. On the Mac and on Android, automatic changes are off until you turn them on, and Almanak only changes the screens you choose. You are responsible for the automations you create and can turn them off at any time.

7. Disclaimer

Almanak is provided "as is" and "as available", without warranties of any kind, to the extent the law allows, including merchantability, fitness for a particular purpose and non-infringement. We don't guarantee that the app or the downloads will be uninterrupted or error-free. Nothing in these terms limits rights you have under consumer law that can't be waived.

8. Limitation of liability

To the extent the law allows, JC Mobile App Studio LLC is not liable for indirect, incidental, special, consequential or punitive damages, or for lost data, profits or revenue, arising from your use of Almanak. Our total liability for any claim is limited to US $50. Some places don't allow these limits, so they apply to you only as far as the law lets them.

9. Apple-specific terms

You and we acknowledge that these terms are between you and us, not Apple. Apple is not responsible for Almanak or its content, has no obligation to provide maintenance or support for it, and has no warranty obligation for it. Apple isn't responsible for claims about the app, including product liability, legal or regulatory compliance, and consumer-protection or intellectual-property claims. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you. You confirm that you are not in a country under a U.S. embargo or on a U.S. list of prohibited or restricted parties.

10. Governing law

These terms are governed by the laws of the Commonwealth of Pennsylvania, United States, without regard to its conflict-of-law rules, and disputes will be heard in the state or federal courts located in Pennsylvania, except where your local consumer law gives you the right to bring a claim where you live.

11. Changes to these terms

We may update these terms. If a change is material we will tell you in the app or on this page, and the date above will change. Using Almanak after an update means you accept it.
