OmniLog Terms of Use

These terms apply to your use of the OmniLog app for iPhone, iPad, Apple Watch, Android and Wear OS ("OmniLog", "the app") from JC Mobile App Studio LLC ("we", "us"). By downloading or using OmniLog you agree to them. If you don't agree, please don't use the app.

Apple's standard license applies too. OmniLog is licensed to you under Apple's Standard End User License Agreement ("Apple EULA"). These terms add to it. If the two conflict on the same point, the Apple EULA controls for the license itself, and these terms control for everything else (subscriptions, data, and how our service works).

1. What OmniLog is

OmniLog helps you keep track of games, books, shows and movies, and the time you spend on them. It is a personal tool. It does not give you the media itself, and it does not play, stream, sell or download any game, book or video.

2. License

We grant you a personal, non-exclusive, non-transferable, revocable license to use OmniLog on Apple devices you own or control, as permitted by the Apple Media Services Terms (including Family Sharing where it applies). You may not copy, modify, reverse engineer, resell or distribute the app, or use it to build a competing service, except where the law lets you regardless of this term.

3. No account

OmniLog has no OmniLog account. Your data belongs to you and lives on your devices and in your own iCloud (see the Privacy Policy). Keeping your devices and your Apple Account secure is up to you.

4. OmniLog Plus (subscriptions and purchases)

Some features require OmniLog Plus. Prices are shown in the app, in your local currency, before you buy.

5. Your content and your data

What you add, such as ratings, notes, tags, lists and sessions, is yours. We claim no ownership. We receive none of it, because it stays on your devices and in your iCloud.

You are responsible for your data. OmniLog keeps dated backups in your iCloud Drive and lets you export everything, but we can't recover data that has been deleted from your devices, your iCloud and your backups, or if you lose access to your Apple Account.

6. Catalog data, covers and third parties

Titles, covers, descriptions, lengths, availability and prices come from third-party catalogs, including IGDB, TMDB, Movie of the Night and Open Library. Those belong to their owners and are shown for your personal use.

7. Estimates, suggestions and AI

Finish forecasts, "what fits tonight", recommendations, recaps and other suggestions are estimates drawn from your own history and from catalog data. Some use Apple Intelligence. They can be incorrect or incomplete, so treat them as a convenience and not as advice. We are not responsible for decisions you make because of them, such as letting a library loan lapse or a subscription renew.

8. Acceptable use

Don't use OmniLog, or our metadata service, to break the law, to harm or overload the service, to scrape or resell its catalog data, to get around its limits, or to interfere with other people's use. We may rate-limit or block abusive traffic.

9. Availability and changes

OmniLog's lookups rely on third parties and on our hosting, so they may be unavailable or change at times. We may update, change or retire features. When we remove a paid feature in a way that materially hurts you, we will tell you and give you a fair option. The app's core, tracking your own library on your device, keeps working offline.

10. Disclaimer

OmniLog is provided "as is" and "as available", without warranties of any kind, to the extent the law allows, including merchantability, fitness for a particular purpose and non-infringement. We don't guarantee that the app will be uninterrupted or error-free, or that suggestions or catalog data will be accurate. Nothing in these terms limits rights you have under consumer law that can't be waived.

11. Limitation of liability

To the extent the law allows, JC Mobile App Studio LLC is not liable for indirect, incidental, special, consequential or punitive damages, or for lost data, profits or revenue, arising from your use of OmniLog. Our total liability for any claim is limited to the greater of the amount you paid us for OmniLog in the 12 months before the claim, or US $50. Some places don't allow these limits, so they apply to you only as far as the law lets them.

12. Ending your use

You can stop at any time by deleting the app and cancelling any subscription. We may suspend access to the metadata service for anyone who breaks these terms. Sections that by their nature should continue to apply after you stop, will.

13. Apple-specific terms

You and we acknowledge that these terms are between you and us, not Apple. Apple is not responsible for OmniLog or its content, has no obligation to provide maintenance or support for it, and has no warranty obligation beyond refunding the purchase price where the Apple EULA provides for it. Apple isn't responsible for claims about the app, including product liability, legal or regulatory compliance, and consumer-protection or intellectual-property claims. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you. You confirm that you are not in a country under a U.S. embargo or on a U.S. list of prohibited or restricted parties.

14. Governing law

These terms are governed by the laws of the Commonwealth of Pennsylvania, United States, without regard to its conflict-of-law rules, and disputes will be heard in the state or federal courts located in Pennsylvania, except where your local consumer law gives you the right to bring a claim where you live.

15. Changes to these terms

We may update these terms. If a change is material we will tell you in the app or on this page, and the date above will change. Using OmniLog after an update means you accept it.
